Final: Compliance and Enforcement Strategy

On 22 October 2024, the commission released its draft compliance and enforcement strategy for stakeholder feedback and in response it received three submissions.

ActewAGL supported the strategy document.

Care Financial requested that impacts of customer wellbeing be considered as a stand-alone factor in deciding a response. The commission has revised section 1.5 in support of this recommendation.

Care Financial also requested the commission consider how to better support consumer empowerment. We have noted this in our ongoing workplan, and we will provide updates through the Consumer Consultative Committee meetings.

Evoenergy sought more clarity on how quickly licensed utilities should report non-compliance and what types of non-compliance must be reported. We have now linked our Material Breach Guideline within the strategy document, which addresses these issues.

Evoenergy also requested a material breach reporting template to assist utilities. The commission has added this for consideration in the 2025 workplan.

In addition, Evoenergy sought clarity on whether the commission would seek enforcement actions if another regulator was already taking action. The commission will evaluate each non-compliance on a case-by-case basis and engage the regulator and take appropriate action.

Draft compliance and enforcement strategy

In May 2024, the ACT Legislative Assembly passed the Independent Competition and Regulatory Commission Amendment Act 2024.

The amendment provides the commission with additional enforcement tools to respond to non-compliance.

In advance of the new enforcement powers coming into effect in December 2024, we have released a draft compliance and enforcement strategy, which is available below. Interested parties were invited to make submissions by Tuesday 12 November 2024.
